DigiKisan aims to simplify the agricultural process and improve productivity through technology-driven solutions.

1.2 User Acknowledgment

 By using DigiKisan, you acknowledge and agree to abide by the terms and conditions set forth by the platform. This includes responsibility for the accuracy of your account information, adherence to the guidelines for using agricultural products, and timely payments for services rendered. You understand that DigiKisan may modify services or terms at any time, and that the platform is not liable for any service interruptions or outcomes of product use. 2. User Eligibility

To access DigiKisan, users must meet the following criteria:

2.1 Age: You must be at least 18 years old.

2.2 Account Accuracy: Users must provide accurate and complete information during registration.

2.3. Geographical Access: DigiKisan services are available in specific regions, so users must be located in areas where we provide delivery and support.

3. App Usage

3.1 Account Registration & Security:

You must provide accurate, up-to-date information when registering for the app. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorized access.

3.2 Permitted Use: The app should only be used for legal purposes related to agricultural purchases and services. You agree not to misuse, exploit, or engage in activities that could damage or disrupt the platform or other users' experiences.

3.3 Prohibited Activities: Do not engage in activities like reverse engineering, distributing malicious code, or conducting unauthorized data collection (e.g., scraping). The app should not be used to harass, abuse, or threaten others.

3.4 Accuracy of Information: You agree to provide accurate information while making purchases or accessing services. Any false information could result in suspension or termination of your account.

3.5 Third-Party Services: DigiKisan may link to third-party services (like payment processors or shipping partners). You agree that DigiKisan is not responsible for the actions or omissions of these third-party services.

3.6 Updates & Modifications: DigiKisan may update or modify features, content, or services without prior notice. You agree to accept changes to the platform.

3.7 Suspension or Termination: DigiKisan reserves the right to suspend or terminate your account if you violate these terms, or if your use is deemed harmful to the platform or other users.

3.8 Limitation of Liability: DigiKisan is not liable for any direct, indirect, or consequential damages arising from the use or inability to use the app, including issues arising from third-party links, services, or content.

4. Products and Services

4.1 Product Availability: While DigiKisan strives to maintain product availability, certain items may go out of stock due to seasonal demand or supply chain limitations. If an item is unavailable after placing an order, you will be notified, and either an alternative will be suggested, or a refund will be issued.

4.2 Pricing: Prices on DigiKisan are dynamic and may fluctuate due to factors like market conditions, supplier changes, or seasonal variations. All prices displayed on the app or website are exclusive of taxes and other applicable fees, which will be added during checkout.

4.3 Returns and Refunds: DigiKisan accepts returns for products that are unused, unopened, and in their original packaging within a specified return window (typically 7-14 days). Refunds will be processed based on the payment method used at checkout, and may take up to 10-14 business days to complete, depending on bank or payment provider procedures.

4.4 Service Use: Services like farm equipment rental, weather updates, or expert guidance are provided to assist farmers, but DigiKisan does not guarantee specific results or outcomes. Equipment rented through DigiKisan must be used according to the manufacturer’s guidelines, and users are responsible for any damage or misuse during the rental period.

4.5 Product and Service Limitations:

DigiKisan is not liable for any damages or losses incurred from using products or services, including those related to crop yield, farm productivity, or external environmental factors. Weather forecasts and expert recommendations are provided as general advice and are not guaranteed to be fully accurate or applicable in every situation.

5. Ordering and Payments

5.1. Placing Orders:

Users must select products, specify quantities, and provide accurate details (e.g., delivery address, contact number) while placing orders. Upon order submission, DigiKisan reserves the right to accept or reject orders based on availability, user account status, and payment confirmation.

5.2 Order Confirmation and Processing: Once an order is placed, an order confirmation email or notification will be sent, containing details like order ID, product(s) purchased, and expected delivery date. Orders are processed only after payment is successfully confirmed. If payment fails, the order will not be processed.

5.3 Pricing and Taxes: Product prices are displayed on the app or website, and may vary based on factors like location, promotions, or seasonal changes. All prices are exclusive of applicable taxes, which will be calculated and added at checkout based on the shipping address.

5.4 Payment Methods: DigiKisan currently accepts payment via Cash on Delivery (COD) and bank transfers/NEFT for larger orders. Please note that online payment methods such as UPI, debit/credit cards, and wallets are not supported at this time.

5.5 Payment Security: DigiKisan ensures the security of all payment transactions by relying on secure, encrypted methods for Cash on Delivery (COD) and bank transfer/NEFT payments. While DigiKisan does not store sensitive payment details (such as bank account or card information), it may use third-party payment processors for verification and transaction processing, where applicable.

All transactions are processed securely through trusted methods, ensuring that user information is protected at all times.5.6 Order Modification and Cancellation: Once the order is placed, modification options may be limited or unavailable, especially if the product has been dispatched. Users can cancel their order before it is processed or shipped. After dispatch, cancellations are not permitted.

5.7 Refunds: In the case of order cancellations or returns, refunds will be processed as per our return and refund policy. Refunds are typically processed to the original payment method and may take 7-10 business days to complete.

5.8 Delivery Charges: Delivery charges may apply depending on the shipping location, order value, and selected delivery method.

Any applicable shipping charges will be calculated and displayed at checkout before finalizing the order.

5.9 Failed Payments and Delays: If a payment fails or an issue arises during payment processing, users will be notified. DigiKisan will not be responsible for delays in processing or shipping due to failed payments.

5.10 Order Disputes: In case of discrepancies or disputes related to the order or payment, users should contact DigiKisan support promptly. DigiKisan will make reasonable efforts to resolve disputes based on available data and our policies.

6. Delivery and Shipping

6.1 Shipping Locations: DigiKisan offers delivery services within India. Availability of delivery services may vary based on location.

6.2 Shipping Costs: Delivery charges are calculated based on the order value, shipping destination, and chosen delivery method, and will be displayed at checkout.

6.3 Delivery Times: Estimated delivery times will be provided during checkout. While we strive to meet these estimates, delivery times may vary due to factors like weather, local conditions, or third-party delays.

6.4 Order Dispatch: Orders are typically processed and dispatched within 2-3 business days. Products in high demand or during peak seasons may have extended processing times.

6.5 Tracking: Once an order is shipped, users will receive tracking details via email or app notifications.

6.6 Failed Deliveries: If delivery fails due to incorrect address or unavailability of the recipient, a re-delivery may be attempted, or the order may be canceled, depending on the situation.

6.7 Damaged or Lost Items: If items are damaged during transit or go missing, users should report the issue within 7 days of receiving the delivery for a resolution under our claims policy.

6.8 International Shipping: Currently, DigiKisan offers shipping only within India. International shipping is not available at this time.

6.9 User Obligations for Providing Accurate Address Details on DigiKisan

6.9.1 Correct Information: Users are responsible for providing accurate and complete shipping information, including the correct address, phone number, and delivery instructions.

6.9.2 Update Details: If there are any changes to the delivery address or contact information, users must update their details in the app before order dispatch to avoid delivery delays.

6.9.3 Consequences of Incorrect Information: DigiKisan is not responsible for failed deliveries or delays caused by inaccurate or incomplete address details provided by the user.

6.9.4 Delivery Confirmation: Users must ensure someone is available at the address to receive the delivery; failed delivery attempts due to absence may incur additional charges for re-delivery.

7. Cancellation, Returns, and Refunds

7.1 Conditions for order cancellations: Orders can be canceled before dispatch. After dispatch, cancellations are not permitted.

7.2 Eligibility criteria for returns: Returns are accepted only for unused, unopened products in original packaging. Returns must be initiated within 3 days from delivery.

7.3 Refund processing timelines and methods: Refunds will be processed based on the payment method used and may take up to 10 business days. Refunds are only issued after product return approval.

7.4 Damaged or Defective Items: If products arrive damaged or defective, users must refuse to take delivery of said item and users must report the issue within 7 days for a replacement or refund.

8. Intellectual Property :

8.1 Ownership of app content (e.g., text, images, trademarks)

8.1.1 All content, materials, designs, logos, trademarks, patents, software, and technologies on the DigiKisan platform are the exclusive property of DigiKisan or its licensors unless explicitly stated otherwise.

8.1.2. Users retain ownership of any content they upload to the platform, provided it does not infringe on the intellectual property rights of others.

8.2 User-Generated Content

8.2.1. By submitting content to DigiKisan (e.g., text, images, videos, data), you grant DigiKisan a non-exclusive, royalty-free, worldwide, transferable, and sub-licensable license to use, reproduce, modify, adapt, publish, and distribute such content for operational purposes.

8.2.2. Users must ensure their uploaded content does not violate third-party intellectual property rights. Any disputes arising from such violations will be the sole responsibility of the user.

8.3 Trademarks and Logos

8.3.1. The DigiKisan name, logo, and related branding are registered trademarks of DigiKisan. Use of these trademarks without prior written consent is strictly prohibited.

8.3.2. Unauthorized use of DigiKisan's branding may result in legal action.

8.4 License to Use

8.4.1. DigiKisan grants users a limited, non-exclusive, non-transferable, and revocable license to use the platform for personal or business purposes related to smart farming.

8.4.2 This license does not include the right to resell, redistribute, or sublicense any part of the platform’s intellectual property.

8.5. Prohibited Activities

8.5.1. Users are prohibited from: Copying, reproducing, or reverse-engineering any part of the DigiKisan platform. Using the platform to distribute malicious content or infringe upon third-party intellectual property rights.

8.5.2. Violations may result in immediate termination of access to the platform and potential legal action.

8.6. Reporting Infringement:

8.6.1. DigiKisan respects the intellectual property rights of others. If you believe your IP has been used without authorization, please contact us at [email protected] with relevant details.

8.6.2. We will investigate claims promptly and take appropriate action, which may include removal of content and termination of user accounts.

8.7. Indemnification

Indirect Damages : DigiKisan and its affiliates, employees, partners, or licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages.

10.2.2. Direct Damages:

DigiKisan's total liability for any direct damages arising out of the use of the app or services shall not exceed the amount paid by the user (if any) for accessing the services in the 12 months preceding the claim.

10.2.3. Farming Outcomes

DigiKisan is not responsible for the success or failure of farming activities based on recommendations or information provided through the app. Users are encouraged to consult with qualified experts before making significant farming decisions.

13. Governing Law and Disputes

13.1. Governing Law

13.1.1. These Terms and Conditions are governed by and construed in accordance with the laws of India, specifically under the jurisdiction of Bemetara, Chhattisgarh, without regard to its conflict of law principles.

13.1.2. Users agree that any disputes arising out of or related to the use of the DigiKisan platform will be subject to the exclusive jurisdiction of the courts located in Bemetara, Chhattisgarh.

13.2. Dispute Resolution

13.2.1. Informal Resolution: Users are encouraged to contact DigiKisan at [email protected] in the event of a dispute to attempt an informal resolution. Both parties will make a good faith effort to resolve disputes amicably within 30 days of receiving notice of the issue.

13.2.2. Arbitration

If a dispute cannot be resolved informally, it will be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 of India.

The arbitration will be conducted in Bemetara, Chhattisgarh, and the language of arbitration will be Hindi or English. The decision of the arbitrator(s) will be final and binding on both parties.

13.2.3. Small Claims Exception

Either party may choose to bring the dispute to a small claims court in Bemetara, Chhattisgarh, if the dispute qualifies under the court's applicable rules.

13.2.4. Class Action Waiver

Users agree to resolve disputes on an individual basis and waive the right to participate in any class action or collective legal proceedings against DigiKisan.

13.3. Injunctive Relief

13.3.1. DigiKisan reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or other proprietary rights.

13.4. Time Limitation for Claims

13.4.1. Users must bring any claims related to the use of DigiKisan within one year from the date the claim arises. Claims filed after this period will be permanently barred.

13.5. Costs and Fees

13.5.1. Each party will bear its own costs and fees related to the resolution of disputes unless otherwise determined by the arbitrator or court.
